RESUMEN

El presente documento analiza la naturaleza de la solicitud de refugio, sus implicaciones en la tardanza de la respuesta y una ruta de acción viable para satisfacer los derechos de los solicitantes. El refugio al ser una figura de protección internacional, responde a situaciones en la que una persona huye por un temor fundado, dicha figura se materializa mediante la solicitud de refugio. Aún cuando dicho documento contiene derechos humanos, en el contexto colombiano se tarda en ser resuelto entre 2 a 3 años, poniendo a los solicitantes en situaciones de vulnerabilidad y desprotección de sus derechos.

ABSTRACT

The work in thesis analyses the refugee status recognition process in Colombia, the current delay related with its institutional response and proposes the authors insights in regards to possible solutions for the applicants context nowadays. The refugee status is a protection measure provided by international law which intends to give shelter to those who are fleeing from their native country and have a founded fear of returning due to specific circumstances. Even though this measure is intended to protect those who are running away, reality has shown that colombian institutions have fallen short since the time of response can vary from 2 to 3 years, leaving applicants unprotected and with their basic human needs unsatisfied.
