ABSTRACT
Law 1805 of 2016 is the most recent regulation in Colombia on donation and transplantation of organs and anatomical components. It was promoted with the main objective of turning Colombia into a donor nation. In spite of this, it can be stated that the Law did not fulfill its goal. On the contrary, it generated a rupture between the legal and medical-practical aspects of organ donation and transplantation. This research aims to understand the impacts of this breach and to understand why the Law turns out to be inoperative in the practical world.

RESUMEN
La Ley 1805 de 2016 es la norma más reciente en Colombia sobre donación y trasplante de órganos y componentes anatómicos. Fue promovida con el objetivo principal de convertir a Colombia en una nación donante. A pesar de esto, se puede afirmar que la Ley no cumplió con su objetivo. Por el contrario, generó una ruptura entre los aspectos legales y médico-prácticos de la donación y el trasplante de órganos. Esta investigación pretende comprender los impactos de esta ruptura y entender por qué la Ley resulta inoperante en el mundo práctico.
